LIBERTY, COUNTY, GEORGIA NOTICE OF SALE UNDER POWER PURSUANT TO AND IN ACCORDANCE WITH and UNDER AND BY VIRTUE of the power of sale and other rights, entitlements, and remedies contained in that Real Estate Deed to Secure Debt (With Future Advance Clause) from OUM SAI SHAKTI NIVAS, INC., as Grantor, to PrimeSouth Bank, as Grantee / Lender, dated December 10, 2014, and recorded on or about December 12, 2014, in the Office of the Clerk of Superior Court of Liberty County, Georgia at Deed Book 1845, Pages 512-525; (hereinafter collectively referred to as the "Deed to Secure Debt"), the said PrimeSouth Bank will sell at public outcry, to the highest bidder for cash or certified funds, before the courthouse door of Liberty County, Georgia, within the legal hours of sale on the first Tuesday in November, 2025, the following described property (hereinafter referred to as the "Premises"): All of that certain tract or parcel of land situate, lying and being in the City of Midway, in the 1359th G.M. District of Liberty County, Georgia, comprising 1.446 acres, more or less, and being known and designated as the Motel & Restaurant Site . upon that certain plat of survey prepared by C. E. Williams for Ima B. Long, dated October 7, 1999 and recorded in the Office of the Clerk of Superior Court, Liberty County, Georgia in Plat Record Book M-14, Page 2, to which plat reference is made for a more particular description of said property. The property herein described has a frontage on U.S. Highway 17 (also sometimes known as the Coastal Highway) and is bounded, now or formerly, as follows: on the North by lands of Midway Historical Church; on the East and South by others lands of Ima B. Long; and on the West by U.S. Highway 17. This being the same properly conveyed from Madikrupa, Inc. to Ohmshanti, Inc. by Warranty Deed dated April 11, 2005 and recorded in the Office of the Clerk of Superior Court, Liberty County, Georgia in Deed Book 1306, Page 176. The said Deed to Secure Debt secures the indebtedness now evidenced by that certain Commercial Promissory Note - Renewal Agreement from OUM SAI SHAKTI NIVAS, INC., as Borrower, to PrimeSouth Bank, as Lender, dated March 6, 2020, and all prior versions, renewals, additions, and extensions thereof, and also including any other indebtedness of the Borrower to the Lender that is actually secured by the said Deed to Secure Debt (hereinafter collectively referred to as the "Promissory Note"). The debt and indebtedness secured by the said Deed to Secure Debt and as shown in that certain Promissory Note, to the Lender, PrimeSouth Bank, have been previously and are hereby again declared due and payable in full because of the failure to comply with certain terms and conditions of the said Deed to Secure Debt and the said Promissory Note, and further, as consequence of the nonpayment thereof. Notice has been given of the acceleration of the indebtedness, and the intention to enforce provisions for collection of attorneys' fees and foreclosure in accordance with legal requirements and the terms of the said Deed to Secure Debt and the said Promissory Note. Due to the indebtedness being and remaining in default, the sale will be made for the purpose of applying proceeds thereof for (1) the payment of the expenses of said sale; (2) the payment of the indebtedness secured by the Deed to Secure Debt, including accrued interest, attorneys fees and any other sums secured by the said Deed to Secure Debt; and (3) the remainder, if any, shall be applied as provided by law and/or in accordance with the said Deed to Secure Debt.
