NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF LIBERTY By virtue of a Power of Sale contained in that certain Security Deed from SETH ALAN GARDNER MILLER and SYDNEY F. MILLER to Mortgage Electronic Registration Systems, Inc. ("MERS"), as Grantee, as nominee for SWBC Mortgage Corp., its successors and assigns, dated March 8, 2024 and recorded on March 11, 2024 in Deed Book 2333, Page 466, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of Three Hundred Forty-Six Thousand Fifty-Five and 00/100 dollars ($346,055.00) with interest thereon as provided therein, as last transferred to SWBC Mortgage Corp., its successors and assigns, recorded in Deed Book 2388, Page 58, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Liberty County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in April, 2026, all property described in said Security Deed including but not limited to the following described property: All that certain lot, tract or parcel of land situate, lying and being In the 17th G. M. District of Liberty County, Georgia, and being in the City of Hinesville, being known and designated as Lot No. 19, Hidden Pines Subdivision, Phase II, as shown and represented on that certain plat of survey made and prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, dated July 12, 1990, and being recorded in Plat Section F-64, Page 3, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being triangular in shape and being bounded, now or formerly, as follows: Northerly by the right of way of Bradwell Street; Easterly by the right of way of Bradwell Street; and Southerly by lands of Harry Sinclair, Jr., all as shown on the above referred to plat of survey. Subject to any Easements or Restrictions of Record. This conveyance is made subject to that certain Restrictive Covenants as contained in that certain Warranty Deed from O. C. Martin, Jr., D. F. Floyd to Atcon Enterprises, Inc., dated April 16, 1976 and recorded in Deed Book 140, Pages 695-697; and that certain Declaration of Restrictions, Conditions, Limitations, Reservations, Easements, Rights Privileges Etc. of Hidden Pines Subdivision, Revised, dated December 8, 1977, and recorded in Deed Book 151, Pages 814-820, and that certain First Amendment to Declaration of Restrictions, Conditions, Limitations, Reservations, Easements, Rights Privileges Etc. of Hidden Pines Subdivision, Revised, dated March 2, 1978, and recorded in Deed Book 153, Pages 817-821, in the Office of the Clerk of Superior Court of Liberty County, Georgia. This conveyance is made subject to that certain 10` sewer easement as shown and represented on that certain plat of survey made and prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, dated July 12, 1990, and being recorded in Plat Section F-64, page 3, in the Office of the Clerk of Superior Court of Liberty County, Georgia. Said property may more commonly be known as 903 Bradwell St, Hinesville, GA 31313. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed.
