STATE OF GEORGIA COUNTY OF LIBERTY NOTICE OF SALE Because of default in the payment of a Promissory Note secured by a DEED TO SECURE DEBT, executed by YASH J. DESAI, AS MANAGER OF J. 1165 OGLETHORPE AVE, LLC to KV WEALTH MANAGEMENT, LLC, dated June 23, 2025 and recorded in Deed Book 2419, Pages 457-467, Liberty County Records, the undersigned has declared the full unpaid amount of the indebtedness referred to due and payable and, acting under the POWER OF SALE contained in said deed, for the purpose of paying said indebtedness, will on the first Tuesday in May, 2026, during the legal hours of sale at the courthouse in said county, sell at public outcry to the highest bidder for cash, the lands described in said deed, to wit: All that certain lot, tract or parcel of land situate, lying and being in the 1476th G.M. District, City of Flemington, Liberty County, Georgia, containing one (1) acres, more or less, and lying on the south side of Oglethorpe Highway (a/k/a State Route 38, U.S. 82). Said property is more particularly described according to that plat thereof made by J.F. Zorn, Surveyor, dated June 4, 1941, which plat is attached to a deed made by Fraser Lumber Company to Wilton Bacon and Charles F. Bacon, said deed being dated June 11, 1941, which, together with said plat, is recorded in Deed Book AAJ, 132 and 133, Liberty County, Georgia records, said plat being incorporated herein and made a part hereof by this reference. Said property is more particularly descried according to that plat entitled "Map showing property of: F.W. Pipkin and John R. Baker, 1476 G.M.D., City of Flemington, Liberty County, Georgia," dated July 28, 1976, and attached as Exhibit "A" to that lease agreement between F. W. Pipkin and John R. Baker, as lessors, and Henry M. Dixon, as lessee, dated August 24, 1976, and recorded in Book 324, page 21, Liberty County, Georgia records, as follows: Commence at a point on the southern boundary line of the right of way of Oglethorpe Highway (a 100' right of way) at an iron pin, said being the POINT OF BEGINNING; from said POINT OF BEGINNING, thence continue along the southern boundary line of said right of way North 65deg00' East for a distance of 157.50 feet to a point; thence leave said right of way and proceed South 25deg15' East for a distance of 279.69 feet to a point; thence proceed South 65deg00' West for a distance of 157.50 feet to an iron pin; thence proceed North 25deg15' West for a distance of 279.69 feet to an iron pin, said point being the POINT OF BEGINNING. This is the same property conveyed to Ogleway Properties, Inc. by Quitclaim Deed from F. W. Pipkin and Billie E. Futch (a/k/a Billie Baker Futch), dated April 17, 1997, and recorded in Deed Book 802, page 188, Liberty County, Georgia records. AND All that certain lot, tract or parcel of land situate, lying and being in the 1476th G.M. District of Liberty County, Georgia, and being in the City of Flemington, and containing 4.080 acres of land, more or less, as shown and represented on that certain plat of survey made and prepared by John O. Parker, Georgia Registered Land Surveyor No. 1850, dated May 26, 2004, and recorded in Plat Section N-43, Page 3C, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northeasterly by Peacock Canal; Southeasterly by lands of Fraser Bros.; Southeasterly Southwesterly by Liberty County, and land of Ogleway Properties, Inc.; and Northwesterly by the right of way of Oglethorpe Highway/SR 38/US 84, all as shown on the above referred to plat of survey. Said property will be sold together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to security deed held by the undersigned. To the best of the undersigned's knowledge and belief, the party in possession of the property is J. 1165 OGLETHORPE AVE, LLC. The undersigned will execute a deed to the purchaser as authorized by the aforementioned DEED TO SECURE DEBT, dated June 23, 2025, the validity of which is expressly continued and the terms of which are expressly incorporated by these Deed to Secure Debt.
